Acceptance of Terms

These Terms & Conditions govern your use of the Seabrook Texas Town website and marketplace. By accessing or using the site, creating an account, or making a purchase, you agree to these terms. If you do not agree, please do not use the site.

Accounts & Eligibility

You must be at least 18 years old (or the age of majority where you live) to create an account or make a purchase. You are responsible for keeping your login credentials secure and for all activity under your account.

Our Role as a Marketplace

The marketplace connects buyers with independent artists and sellers. Sellers are responsible for their own listings, including artwork, descriptions, and pricing. We provide the platform, payment processing, and (where applicable) print-and-ship fulfillment, but we are not the creator of seller-listed artwork.

Orders & Payments

Prices are shown in U.S. dollars. Payments are processed securely by Stripe. By placing an order, you authorize us to charge your payment method for the order total, including applicable taxes and shipping. We may cancel or refuse an order if we suspect fraud, an error in pricing, or a violation of these terms.

Seller Terms

Sellers receive payouts through Stripe Connect, less the platform commission disclosed in your seller dashboard.
You retain ownership of artwork you upload, and grant us a license to display, market, and reproduce it for the purpose of operating the marketplace and fulfilling orders.
You represent that you own or have the rights to all content you upload and that it does not infringe any third-party rights.
Prohibited content includes anything unlawful, infringing, hateful, or otherwise objectionable. We may remove listings that violate these terms.

Intellectual Property

The site, its branding, and its original content (excluding seller-uploaded artwork) are owned by us and protected by applicable law. You may not copy or reuse them without permission.

Prohibited Conduct

You agree not to:

Use the site for any unlawful purpose or to infringe others' rights.
Attempt to interfere with, probe, or disrupt the site or its security.
Upload malicious code or scrape data without permission.
Misrepresent your identity or your right to sell any item.

Disclaimers & Limitation of Liability

The site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the site or any purchase made through it.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising out of your use of the site, your content, or your violation of these terms.

Governing Law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules.

Changes to These Terms

We may update these terms from time to time. Continued use of the site after changes take effect constitutes acceptance of the updated terms.
